A claim or injunction against a Dutch debtor can be requested at short notice by a Dutch attorney. If a monetary claim is straightforward and is not disputed (or can hardly be contested), then quick relief proceeding may be started before a Dutch Court.
The judge will investigate whether the claim is indeed strong enough to be allowed in preliminary relief proceedings and whether the facts and circumstances require an immediate provisional judgment. The risk of repayment will also be assessed.

Remedies available against a Dutch defendant in preliminary relief proceedings

Apart from monetary claims, the available injunctions and remedies in preliminary relief proceedings are usually a prohibitory injunction or a mandatory injunction. Usually the claimant will also request the judge to include a penalty in the judgment for each day the defendant fails to comply with the judgment.

Dutch attorney can obtain a judgment at short notice

The Dutch attorney for the claimant will request a date for the court hearing. As soon as the date is fixed, the writ of summons will be issued and the defendant is not obliged to file a defense before the date of the court hearing.

The defendant may defend himself orally at the court hearing. Documents should be filed by the defense 24 hours before the court hearing. The judgment can be enforced immediately. An appeal by the defendant in preliminary relief proceedings typically does not suspend enforcement of the judgment.
