Update on gambling license in the Netherlands

For gambling in The Netherlands licences can be provided by the Netherlands gaming authority. The gaming authority is also responsible for lottery licenses. Charity lotteries will be allowed as per January 1, 2017. The Dutch ministry is preparing a new gaming law and gambling license granting system, including licensing for online gaming. An application for a gambling license in the Netherlands may be subject to a screening procedure under Dutch integrity law (called “Wet Bibob”). Netherlands Regulation for Dutch Casino’s

At the moment licensing for casino’s is on the move. The Dutch government has allowed new providers to enter the Dutch market. They will release two new casino licenses as per 2017. The expectation is that from 2017 onward at least 16 casino’s will exist. The Netherlands gaming authority is both the licensor for the gaming industry, as well as the regulator. As soon as a new policy is available, the Netherlands gaming authority will start issuing licenses in the new policy for casino’s.

Law enforcement of gambling law in The Netherlands

The Dutch gaming authority takes care of law enforcement against illegal gaming. Because online gaming is still prohibited in The Netherlands, offenses of the Dutch gambling law can be subject to law enforcement. Offering games (online) without any license is an infringement of the Dutch gaming law. A maximum fine of EUR 780,000,- can be forced. An administrative law procedure is available to contest the fine or sanction of the Dutch gaming authority. Remote games of chance in The Netherlands

Dutch government is working on the remote gambling law for The Netherlands. The draft Betting and Gaming Act in The Netherlands, which gives a definition of games of chance for remote online poker, casino games, sports, bets, life betting on sports, et cetera. A license for online games of chance in The Netherlands is required under the new law. If the applicant meets the conditions for granting the license a license can be submitted. A provider already has a license in a different EU member state, this is not reason to grant a license for gaming in The Netherlands. The applicant for the license in The Netherlands should have a statutory seat in The EU. The license cannot be transferred without permission of the Dutch gaming authority. The new Dutch law on onlinegaming is expectied in the course of 2016/2017.
